Terms of Service

About these Terms

freecode is a free coding agent. These Terms of Service govern your use of its website, applications, accounts, and related services and form an agreement between you and Andrew Schmitz, operator of freecode ("freecode," "we," or "us").

By accepting these Terms or using the service, you agree to them. If you do not agree, do not use the service. Our Privacy Policy explains how we process information.

Eligibility and accounts

You must be at least 13 and meet any higher minimum age applicable where you live. If you are under 18 or the age of legal adulthood where you live, you must have a parent or guardian's permission to use freecode. Features may be subject to additional legal or provider requirements.

Provide accurate account information, keep your account and connected devices secure, and contact us if you suspect unauthorized access. If you use freecode for an organization, you must have authority to accept these Terms and provide its information.

Your work

"Content" includes prompts, messages, code, files, tool results, and other material you submit or make available through freecode, together with output generated for you. You retain your rights in Content you provide. As between you and freecode, we do not claim ownership of your output and assign to you any assignable rights we acquire in it. Output may not be unique or eligible for copyright protection, and other parties' rights remain applicable.

You grant freecode a non-exclusive, worldwide, royalty-free license to process Content as reasonably needed to provide, secure, support, and improve the service. Subject to the notices, permissions, and restrictions in the Privacy Policy, this includes contributor-provider evaluation and training and preparing and licensing eligible messages and usage data to approved partners for AI evaluation, development, and training. This license does not override privacy rights or expand permissions for information collected under earlier policies.

You are responsible for having the rights and permissions needed for the applicable use of Content. Do not provide credentials or confidential information without authorization, except through features intended to receive it. Review applicable licenses before using or distributing generated material.

Using the agent

The agent can read and change files, run commands, and interact with services within the access you provide. Generated output and automated actions may be incorrect, insecure, incomplete, or unsuitable. Review changes, maintain backups, and use permission controls before granting access to important systems. Output is not professional advice.

Acceptable use

You may not use freecode to violate the law or another person's rights, harm or exploit others, access systems without authorization, distribute malware, or disrupt the service. You may not evade security or usage limits, create or rotate accounts or devices to multiply free allowances, or resell service access without our permission. Ordinary agent automation through supported features is permitted.

Service availability and third parties

freecode is in alpha/beta. Features, models, availability, and usage limits may change. Free access is subject to limits and is not a guarantee of uninterrupted, unlimited, or permanent service. We will obtain your agreement before introducing a charge that requires it.

Sponsored recommendations help support the service, are labeled in the interface, and are not endorsements. Third-party services have their own terms. Commercial arrangements supporting freecode do not entitle you to compensation, royalties, a particular model, or a guaranteed level of access.

Suspension and termination

We may limit or suspend access to investigate abuse, comply with law, protect the service or others, or address a material breach of these Terms. Where practical and safe, we will explain the reason and provide a way to request review. You may stop using freecode at any time or contact us to request account closure. Retention and deletion are addressed in the Privacy Policy.

Security reports

Report suspected vulnerabilities to andrew@freecode.sh with the affected version or URL and a minimal safe reproduction. Avoid accessing others' information or interrupting the service, and coordinate disclosure so affected users can be protected. We do not currently offer a public bug bounty, reward, or fixed response time.

Disclaimers and liability

To the extent permitted by law, freecode is provided "as is" and "as available," without warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation.

If you use freecode as a consumer, your mandatory consumer remedies remain available. For business use, to the extent permitted by law, we are not liable for indirect or consequential loss, lost profits, or lost business opportunities, and our total liability arising from the service or these Terms is limited to the greater of US$100 or the amount you paid us in the preceding 12 months. These exclusions and limits do not apply to fraud, willful misconduct, or liability that cannot lawfully be limited.

General provisions

Separate open-source licenses govern the components they cover. Other than your Content and expressly granted rights, freecode's software, branding, and materials belong to us or our licensors. We may use suggestions you voluntarily provide to improve the service without compensation; this does not grant unrestricted rights to private attachments or support conversations.

If a provision is unenforceable, the remainder continues where legally possible. Failure to enforce a provision is not a waiver. We may transfer this agreement in connection with a reorganization or sale of the business, subject to applicable rights and the Privacy Policy. Provisions needed to resolve existing disputes survive termination. Disputes may be brought before courts with jurisdiction under applicable law; nothing here removes mandatory consumer protections or local remedies.

Changes and contact

We may update these Terms and will show the effective date and provide appropriate notice of material changes. Changes apply prospectively. Additional permission required for a new data use must be obtained before that use begins. If you do not accept updated Terms, you may stop using the affected service.
